Welcome to Dataspace Pvt. Ltd. (“we,” “us,” “our,” or “Dataspace”). Please read these Terms of Service (“TOS”) carefully before accessing or using any of our services. By accessing or using any services provided by Dataspace, you agree to comply with these terms. These terms apply to all customers, visitors, and users of our website and services. If you do not agree with any part of these terms, you should not use our services.
- Scope of Services
Dataspace Pvt. Ltd. offers a variety of IT infrastructure, cloud solutions, and web development services. These include, but are not limited to:
- Web Hosting (Shared, Reseller)
- Virtual Private Servers (VPS)
- Co-location
- Enterprise Email
- Website Design and Development
- Backup and Disaster Recovery Solutions
- Bare Metal Server
- End-point Security
- Network Solutions and Consulting
- Annual Maintenance Service
Our services are aimed at individuals, businesses, and organizations who require reliable digital infrastructure and solutions. By signing up for our services, you acknowledge that you have read and agree to these terms and conditions, and any additional service-specific policies that may apply.
- Eligibility and Account Registration
2.1 Age Restriction
You must be at least sixteen (16) years of age to register for or use any services from Dataspace Pvt. Ltd. If you are under sixteen, you are prohibited from registering, using, or accessing the services.
2.2 Accuracy of Information
You agree to provide accurate, complete, and up-to-date information during the registration process. This includes your contact information, billing information, and other relevant details. If you provide incorrect or outdated information, Dataspace reserves the right to suspend or terminate your account without notice.
2.3 Account Security
You are responsible for maintaining the confidentiality of your account credentials, including your username and password. Any activity conducted under your account is your responsibility. In the event of unauthorized access to your account, you must notify Dataspace immediately to take corrective action.
- Billing, Payment, and Renewal
3.1 Payment Terms
Customers agree to pay all fees associated with the services they subscribe to, in advance, according to the billing cycle (monthly, annually, or otherwise).
Web Hosting & Reseller Hosting: Annual billing unless specified otherwise.
Cloud Hosting & VPS: Monthly billing.
Dedicated Servers: Monthly or as otherwise specified in your contract.
Invoices are generated based on the subscription package you select. All payments must be made via the payment methods specified on our website, including bank transfers, and other options as applicable.
3.2 Auto-Renewal
All services are set to automatically renew unless canceled before the renewal date. You authorize Dataspace to charge your payment method on file for any renewal fees, and failure to provide accurate billing information may result in suspension or termination of service.
3.3 Late Payments
Payments must be made on time. If any invoice is not paid within seven (7) days of the due date, Dataspace reserves the right to suspend or terminate your account. Late fees may apply, and access to your account will be withheld until the outstanding balance is cleared.
3.4 Taxes
All fees listed on our website or invoices include any applicable sales, VAT, or other taxes imposed by government authority. Customers are responsible for paying all applicable taxes.
- Cancellation and Refund Policy
4.1 Cancellation Process
To cancel any service, you must submit a written cancellation request through our official communication channels (e.g., email, support portal) before the service’s renewal date. Dedicated Servers and VPS services require a minimum of three (3) business days’ notice before the next billing cycle.
4.2 Money-Back Guarantee
We offer a 30-day money-back guarantee on shared, reseller, and cloud hosting services. This does not apply to VPS or dedicated servers.
If you cancel within 30 days of signing up for eligible services, you will receive a refund minus a 10% cancellation fee.
4.3 Non-Refundable Fees
All administrative fees, setup fees, and additional services (e.g., migration assistance, SSL certificate installation) are non-refundable. In the event of termination due to a violation of these terms, no refund will be provided.
- Service Suspension and Termination
5.1 Suspension of Service
Dataspace reserves the right to suspend your account without prior notice if:
- Payments are overdue.
- You violate any of the terms outlined in this agreement, including our Acceptable Use Policy.
- Your account poses a security risk to our infrastructure or other customers.
5.2 Termination
Your account may be terminated without notice if:
- You fail to remedy a violation after being notified.
- Your actions negatively impact Dataspace’s business, reputation, or other customers.
- You engage in illegal activities or other prohibited conduct as outlined in our Acceptable Use Policy.
Upon termination, all data associated with your account may be deleted permanently. It is your responsibility to maintain backups of any important data.
- Acceptable Use Policy (AUP)
6.1 Lawful Use
All services provided by Dataspace Pvt. Ltd. must be used for lawful purposes only. The use of any services to infringe upon copyright or conduct illegal activities is strictly prohibited. This includes:
- Hosting or distributing illegal content (e.g., pirated software, music, videos).
- Engaging in phishing, fraud, or hacking activities.
- Violating intellectual property rights.
6.2 Prohibited Activities
The following activities are prohibited and may result in immediate suspension or termination of services:
- Hosting malware, viruses, or any harmful code.
- Using services for spamming, mail bombing, or sending unsolicited bulk emails.
- Using the server for resource-intensive activities such as cryptocurrency mining or running IRC scripts/bots.
- Participating in any file-sharing or peer-to-peer (P2P) networks.
- Running gaming servers (e.g., Counter-Strike, Minecraft).
6.3 Resource Limits
Customers using shared hosting plans must adhere to resource limits outlined in their package. Disk usage in excess of 50GB for shared hosting plans may result in exclusion from backup routines. Excessive use of system resources (e.g., CPU, memory) may lead to account suspension.
- Backups and Data Loss
While we provide weekly backups for shared hosting accounts, these are provided as a courtesy and are not guaranteed. We encourage all customers to maintain their own backups of important data.
Backups are retained for two weeks, and restoration requests may incur a fee.
Dedicated server and VPS customers are responsible for their own backup strategies.
Dataspace Pvt. Ltd. is not responsible for any loss of data resulting from hardware failure, human error, or third-party attacks.
- Limitation of Liability
Dataspace Pvt. Ltd. makes no guarantees of uninterrupted or error-free service. While we strive to maintain a 99.9% uptime, factors beyond our control, such as DDoS attacks, hardware failures, or third-party service interruptions, may affect service availability.
We are not liable for any indirect, incidental, or consequential damages, including loss of data, revenue, or profits.
Dataspace shall not be responsible for damages incurred due to delays, service interruptions, or the inability to access data or services.
- Indemnification
You agree to indemnify and hold harmless Dataspace Pvt. Ltd., its affiliates, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from:
Your use of our services.
- Violations of this TOS or our Acceptable Use Policy.
- Any infringement of third-party rights, including intellectual property rights.
- Privacy and Data Protection
We are committed to safeguarding your personal information. Please refer to our Privacy Policy for details on how we collect, store, and process your data.
- Amendments to Terms and Conditions
Dataspace Pvt. Ltd. reserves the right to modify these Terms of Service at any time. Customers will be notified of significant changes via email or a notice on our website. Continued use of our services after changes to these terms constitutes acceptance of the updated TOS.
